Terms of service
OVERVIEW
Welcome to Velamuse. The terms “we,” “us” and “our” refer to Velamuse.
Velamuse operates this online store and website, including the related information, content, features, tools, products and services offered through it, collectively referred to as the “Services.” Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services.
These Terms of Service, together with the policies referenced in them, explain your rights and responsibilities when accessing or using the Services.
Please read these Terms carefully. They contain important information concerning orders, payments, deliveries, intellectual property, liability and the use of our website.
By accessing or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree to these Terms, you should not access or use the Services.
Nothing in these Terms limits rights or remedies that cannot lawfully be excluded or restricted.
SECTION 1 - ACCESS AND ACCOUNT
You must be at least 18 years old to place an order through the Services. If you are under 18, you may use the Services only with the involvement and permission of a parent or legal guardian.
You may browse the store without creating an account. When placing an order or using certain features, you may be asked to provide information including your name, email address, telephone number, billing address, delivery address and payment details.
You agree that information supplied to us will be accurate, current and complete and that you are authorised to provide and use that information.
You are responsible for protecting your account credentials and for activity carried out through your account. Please notify us promptly if you believe that your account has been accessed without permission.
You may not sell, transfer, assign or license your account to another person.
SECTION 2 - OUR PRODUCTS
We aim to display and describe our products accurately. Product photographs, descriptions, sizes, colours, specifications, availability and prices are provided to help customers make informed purchasing decisions.
Colours and product appearance may vary slightly because of lighting, photography, screen settings and device displays. Such minor display differences do not necessarily mean that a product is defective.
Footwear sizing and fit can vary between designs and manufacturers. Customers should review the size information displayed on the relevant product page before ordering.
Products supplied by Velamuse will be as described, of satisfactory quality and fit for their normal intended purpose.
We may update product descriptions or discontinue products that have not already formed part of an accepted order. We may also limit quantities where reasonably necessary, including because of stock availability, delivery restrictions or suspected misuse.
Product availability displayed on the website is subject to confirmation when an order is processed.
SECTION 3 - ORDERS
Submitting an order constitutes an offer to purchase products from Velamuse.
After an order is submitted, you may receive an automated acknowledgement. This confirms that we received the order but does not necessarily mean that it has been accepted.
An order is accepted when we send confirmation that it has been approved or dispatched. Payment may be authorised before final acceptance.
We may decline or cancel an order for reasonable grounds, including:
- The product is unavailable.
- Payment cannot be authorised.
- The delivery address is outside an available service area.
- The order information is incomplete or inaccurate.
- An obvious pricing or product-information error has occurred.
- Fraudulent, unauthorised or abusive activity is reasonably suspected.
- Quantity or purchase restrictions have been exceeded.
If we decline or cancel an order after collecting payment, the relevant amount will be returned to the original payment method.
Please review your order carefully before submitting it. If you need to request a change or cancellation, contact us as soon as possible. We cannot guarantee that an order can be changed after processing or dispatch has begun.
Returns, replacements and refunds are handled according to our Return and Refund Policy.
Products purchased through the consumer checkout are intended for personal or household use and must not be purchased for unauthorised commercial resale.
SECTION 4 - PRICES AND BILLING
Prices for customers shopping in the United Kingdom are displayed in Pound Sterling (GBP/£).
Displayed product prices include applicable taxes where required. Available delivery charges, discounts and the final payable total will be shown before you submit payment.
The price charged will be the price displayed during checkout and confirmed in your order summary, subject to the correction of an obvious error under Section 12.
We will not intentionally add undisclosed product, service or handling charges after an order has been submitted.
Prices, promotions and discounts may change before an order is placed. A price change will not normally affect an order that has already been accepted.
Promotions may be subject to separate eligibility requirements, expiry dates or product restrictions. If specific promotional terms conflict with these Terms, the promotional terms will apply to that promotion.
You agree to provide accurate and complete billing, payment and account information. You confirm that you are authorised to use the selected payment method.
Your bank or payment provider may apply currency-conversion or international transaction charges. These charges are imposed by the provider and are not collected or controlled by Velamuse.
SECTION 5 - SHIPPING AND DELIVERY
Order processing periods, available delivery methods, estimated delivery times and applicable delivery charges are explained in our Shipping Policy.
Delivery estimates are not guaranteed dates. Delays may occur because of carrier disruption, adverse weather, public holidays, address problems, customs processing or other circumstances outside our reasonable control.
We remain responsible for products until they are delivered to you or to a person identified by you to receive them. If you independently appoint a carrier that was not offered by Velamuse, responsibility may transfer when the order is handed to that carrier.
You are responsible for providing an accurate and complete delivery address. Contact us promptly if you identify an address error. We cannot guarantee that an address can be changed after dispatch.
If an order is delayed, lost or damaged during delivery, contact us so that we can review the tracking information and provide appropriate assistance.
SECTION 6 - INTELLECTUAL PROPERTY
The Services and their content—including authorised text, graphics, photographs, videos, logos, branding, layouts, software and website design—are owned by, licensed to or lawfully used by Velamuse and are protected by applicable intellectual-property laws.
You may access and use the Services for personal, non-commercial shopping purposes.
Without prior written permission, you must not:
- Reproduce or republish substantial website content.
- Modify or create derivative works from protected content.
- Sell, license or commercially exploit website materials.
- Remove copyright, trademark or ownership notices.
- Use Velamuse branding in a misleading or unauthorised manner.
- Suggest an endorsement, partnership or affiliation that does not exist.
No provision in these Terms transfers ownership of intellectual property belonging to Velamuse, Shopify, a product supplier or another rights holder.
The Velamuse name, branding and logos may not be used without appropriate permission. Shopify’s names, logos and related marks belong to Shopify or its licensors. Other trademarks displayed through the Services belong to their respective owners.
SECTION 7 - OPTIONAL TOOLS
The Services may provide access to features or tools supplied by third parties.
Third-party tools may be governed by separate terms and privacy policies. Before using an optional tool, you should review the conditions provided by its operator.
We do not control every aspect of independent third-party tools and cannot guarantee their continuous availability. However, nothing in this section excludes responsibility that cannot lawfully be excluded.
We may introduce new website tools, features or resources. Unless separate terms are presented, those features will form part of the Services and will be subject to these Terms.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain links to websites, resources or platforms operated by third parties.
We do not control independent third-party websites and are not responsible for their content, availability, security or privacy practices. The presence of a link does not necessarily constitute an endorsement.
If you leave our website, you should review the third party’s terms and privacy policy before providing information or completing a transaction.
Questions or complaints concerning products or services purchased directly from a third party should be directed to that third party. This section does not apply where Velamuse is legally responsible for the relevant product, service or representation.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Velamuse is powered by Shopify, which provides the ecommerce platform used to operate the Services.
Purchases made through our store are transactions directly between you and Velamuse. Velamuse is responsible for the products it sells, order fulfilment and customer support relating to those purchases.
Shopify is not the seller of products offered by Velamuse and does not independently control our product descriptions, prices, deliveries, returns or refunds.
Nothing in this section excludes any responsibility that Shopify or Velamuse may have under circumstances where liability cannot lawfully be excluded.
SECTION 10 - PRIVACY POLICY
Personal information collected through the Services is handled according to our Privacy Policy.
Because Shopify hosts the Services, Shopify also collects and processes certain information concerning access to and use of the store. Information submitted through the Services may be transmitted to Shopify and to relevant service providers, including providers located outside the country in which you live.
Further information about Shopify’s processing practices is available in the Shopify Consumer Privacy Policy and through the Shopify Privacy Portal.
Please review our Privacy Policy for more information about the personal information we collect, why we use it, who may receive it and the rights available to you.
SECTION 11 - FEEDBACK
If you voluntarily submit a review, suggestion, idea, photograph or other feedback relating to Velamuse or the Services, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish and display that feedback for operating, improving and promoting the Services.
This licence does not transfer ownership of your original content to Velamuse.
You confirm that:
- You created the feedback or have permission to submit it.
- The feedback is accurate and based on your genuine experience.
- You have disclosed any payment, free product or incentive connected with it.
- The feedback does not infringe another person’s rights.
- The feedback is not unlawful, abusive, defamatory, misleading or obscene.
- The feedback does not contain malware or harmful code.
We may moderate or remove feedback that violates these Terms or applicable requirements. We are not required to publish, retain, respond to or provide compensation for unsolicited feedback.
Do not submit confidential information through reviews or other public features.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
We aim to keep information concerning product descriptions, prices, promotions, delivery charges, delivery estimates and availability complete and accurate.
If we identify an error before an order is accepted, we may correct the information and ask you to resubmit or confirm the order.
If an obvious pricing or product-information error is discovered after an order has been submitted, we may contact you to offer the option of proceeding with the corrected information or cancelling the affected order for a full refund.
We will not use this section to make arbitrary changes to an accepted order or remove customer rights.
Website content may be updated without prior notice where the change does not alter an existing accepted order.
SECTION 13 - PROHIBITED USES
You may use the Services only for lawful purposes.
You must not use the Services:
- To engage in unlawful, fraudulent or malicious activity.
- To infringe intellectual-property, privacy or other rights.
- To harass, threaten, abuse, defame or impersonate another person.
- To provide materially false or misleading information.
- To distribute spam, unsolicited promotions or deceptive communications.
- To upload viruses, malware or other harmful code.
- To interfere with the operation or security of the Services.
- To collect another person’s information without authority.
- To attempt unauthorised access to an account, system or network.
- To bypass access controls, rate limits, security features or robot-exclusion measures.
- To copy, scrape, extract, resell or commercially exploit the Services without permission.
- To use automated systems or artificial-intelligence agents contrary to Section 14.
Where reasonably necessary, we may restrict or suspend access connected with a material breach of these Terms, suspected fraud, security risk or unlawful conduct.
SECTION 14 - AGENTS
14.1 This section applies if you use, authorise or deploy an automated or semi-automated software system to access or interact with the Services. Such a system is referred to as an “Agent.”
14.2 An Agent must not access or interact with the Services if we have expressly requested that it stop or if its use would breach these Terms.
14.3 We may use reasonable technical measures to control whether and how Agents access or interact with the Services.
14.4 An Agent accessing the Services must:
- Identify itself as an automated system where technically required.
- Provide an accurate Agent name through its user-agent information where applicable.
- Not conceal its automated nature by deceptively imitating human behaviour.
- Not bypass CAPTCHAs, access controls, security systems or rate limits.
- Respond truthfully when asked whether an interaction is automated.
- Not place unauthorised orders or provide false customer information.
- Not collect, process or disclose personal information without authority.
- Follow applicable technical restrictions and website instructions.
Nothing in this section authorises an Agent to enter into a transaction without the permission of the person or organisation it represents.
SECTION 15 - TERMINATION
You may stop using the Services at any time.
We may restrict, suspend or terminate access where reasonably necessary because of:
- A material or repeated breach of these Terms.
- Fraudulent, unlawful or abusive activity.
- A threat to the security or operation of the Services.
- Non-payment of an amount properly due.
- A legal or regulatory requirement.
- Discontinuation of the relevant Service.
Where practical and appropriate, we will provide notice or an explanation. Termination will not remove rights or obligations that arose before termination.
Provisions concerning intellectual property, privacy, payments, liability, governing law and any other provisions intended by their nature to continue will survive termination.
SECTION 16 - DISCLAIMER OF WARRANTIES
We take reasonable steps to keep the website and its general information accurate and available. However, we do not guarantee that the website will always be uninterrupted, completely secure or free from technical errors.
General website content is provided for informational and shopping purposes and should not be treated as professional advice.
Nothing in these Terms excludes or restricts requirements that products must be as described, of satisfactory quality and fit for their normal or communicated purpose.
Any limitations in this section apply only to the extent permitted and do not affect rights that cannot lawfully be excluded.
SECTION 17 - LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Deliberate misconduct.
- Breach of obligations that cannot lawfully be excluded.
- Products that are not as described, of satisfactory quality or fit for purpose.
- Any other liability that cannot legally be limited.
If Velamuse fails to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of that failure or our failure to use reasonable care and skill.
We are not responsible for loss or damage that was not reasonably foreseeable when the contract was formed.
Where you purchase as a consumer, we are not responsible for business losses, including loss of profit, revenue, opportunity or business interruption, because the Services are intended for personal and household use.
SECTION 18 - INDEMNIFICATION
You are responsible for reasonable losses or costs directly caused by your deliberate unlawful use of the Services, your fraudulent conduct or your knowing infringement of another person’s rights.
This section does not require a consumer to compensate Velamuse for losses caused by Velamuse, losses that are not reasonably foreseeable or amounts that would be unfair or disproportionate.
We will provide reasonable notice of a relevant claim and allow appropriate participation in its handling where applicable.
Nothing in this section limits rights or protections that cannot lawfully be excluded.
SECTION 19 - SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent necessary.
The remaining provisions will continue to apply unless the removal of the affected provision makes continued performance of the agreement impossible or fundamentally changes its purpose.
SECTION 20 - WAIVER; ENTIRE AGREEMENT
A delay or failure by either party to exercise a right under these Terms does not automatically waive that right.
These Terms, together with the policies expressly incorporated into them, form the agreement between you and Velamuse concerning use of the Services and purchases made through the store.
They replace earlier versions or communications dealing with the same subject, except where a separate written agreement expressly applies.
If a consumer term could have more than one reasonable meaning, the interpretation most favourable to the consumer will apply where required.
SECTION 21 - ASSIGNMENT
You may not transfer your account or contractual obligations to another person without our prior written agreement.
Velamuse may transfer its rights or obligations as part of a genuine business sale, restructuring or service arrangement, provided that the transfer does not reduce your existing contractual rights.
Where a transfer materially affects you, we will provide reasonable notice.
SECTION 22 - GOVERNING LAW
These Terms and contracts formed through the Services are governed by the laws of England and Wales.
The courts of England and Wales will have jurisdiction, except that consumers living in Scotland or Northern Ireland may rely on mandatory protections applicable where they live and may bring proceedings in their local courts where permitted.
Nothing in this section removes rights that apply to a consumer because of their place of residence.
SECTION 23 - HEADINGS
Headings are included for convenience and organisation only. They do not alter or limit the meaning of these Terms.
SECTION 24 - CHANGES TO TERMS OF SERVICE
The current version of these Terms is available on this page.
We may update these Terms to reflect changes to the Services, business operations, security requirements or applicable obligations.
Material changes will be posted on the website and, where appropriate, communicated through email or another reasonable method. The updated version will state the date on which it takes effect.
Changes will not normally apply retroactively to an order accepted before the updated Terms became effective.
Your continued use of the Services after an updated version takes effect constitutes acceptance of the revised Terms for future use.
